Effective 31 October 2026 · Ljubljana, Slovenia
1. Who we are and what these terms cover
These Terms of Business apply to everything OUR3D ("we", "us") supplies to a client or customer ("you"). OUR3D is a brand of Vizualne komunikacije Predrag Petrović s.p., Švabićeva ulica 3, 1000 Ljubljana, Slovenia, registration number (matična številka) 1784510000, VAT ID SI76739015. You can reach us at info.our3d@gmail.com.
They cover two things: studio Services (3D visualisation, animation, AI-assisted film and image production, motion graphics, procedural effects and related consulting) and Products (software plugins and other digital goods sold through our online store). A written quote or agreement confirmed by both sides takes priority over these terms where the two differ.
2. Quotes and project brief
- A quote is based on the brief you give us and stays valid for 30 days unless it says otherwise.
- A contract exists once you accept the quote in writing. Email is enough.
- Changes to scope, formats, running time or deadline after acceptance are quoted separately.
- Delivery dates depend on you supplying materials, feedback and approvals on time. If these are late, the dates move by the same amount.
3. Fees and payment
- Prices are in euro and exclude VAT, which is added where it applies.
- For larger projects we may ask for a deposit before work begins. The balance is due when the final files are delivered, as stated in the quote.
- Invoices are payable within 14 days of the invoice date unless the quote says otherwise. For late payment we may charge statutory default interest and pause work until the account is settled.
- Costs paid to third parties for your project, such as stock assets, fonts, licences or extra render capacity, are agreed with you in advance.
4. Revisions and approval
- Each deliverable includes two rounds of consolidated revisions unless the quote says otherwise.
- Further rounds, and changes of direction after you have approved a stage (blockout, look development, animatic), are charged separately.
- Written approval of a stage is final for that stage. Delivered work counts as accepted if we receive no written feedback within 7 days.
5. Your materials
You confirm that you hold the rights to the logos, models, footage, text, music, reference images and other material you give us, and that using them does not infringe anyone else's rights. You are responsible for any claim that arises from material you supplied.
6. AI-assisted work
- Some Services use generative AI tools for images, video, voice or text. We use them under their commercial terms and tell you on request which kinds of tool were used.
- AI output may enjoy less copyright protection than conventionally made work and may resemble existing works. We do not guarantee that AI-generated elements are exclusive or registrable.
- We do not upload your confidential material to AI tools without your approval.
- We do not generate the likeness or voice of a real person, or a protected brand or character, without proof of permission from that person or rights holder. We decline briefs that are deceptive, defamatory or unlawful.
7. Intellectual property
- Once an invoice is paid in full, you receive the right to use the final deliverables for the purposes described in the quote. Until then all rights stay with us and drafts may carry a watermark.
- Third-party elements, such as licensed assets or fonts, remain under their own licences, and we point these out.
- Unless agreed otherwise in writing, we keep ownership of working files: project scenes, scripts, procedural setups, tools and know-how.
- We may show finished work in our portfolio and on our channels. If you need it kept private, tell us in writing before the project starts.
8. Confidentiality
Each side keeps the other's non-public information confidential and uses it only for the project. This does not apply to information that is already public, was already known to the receiving side, was developed independently, or must be disclosed by law. We will sign a separate NDA on request before the project begins.
9. Software plugins and digital products
- Licence. Buying a Product gives you a non-exclusive, non-transferable licence to install and use it for your own projects, commercial ones included. One licence covers one host application (for example Maya, Houdini or Blender) and one user, who may install it on up to two computers they use themselves, unless the product page says otherwise. The Maya, Houdini and Blender versions are separate Products.
- Restrictions. You may not resell, share, sublicense or publish a Product, its files or its licence details. You may not reverse engineer it except where the law allows.
- Delivery and updates. Products are delivered digitally through our Gumroad store and are available to download after payment. We may publish updates but do not promise compatibility with future versions of the host application. System requirements are listed on each product page.
- Support. Write to info.our3d@gmail.com. We reply as soon as we can, usually within a few working days.
- Payment and tax. Payments, receipts and taxes for Products are processed by Gumroad under its own terms.
Google data. Products that load Google Photorealistic 3D Tiles need your own Google Maps Platform API key and billing account. The map data belongs to Google and is not sold or licensed by us. You alone are responsible for:
- following the Google Maps Platform Terms of Service and the Map Tiles API policies, including attribution, caching and storage limits, and rules on offline use and permitted purposes;
- all charges Google makes for your API usage, and for keeping your key secret;
- checking that your intended use of imported data, especially commercial use or publication, is allowed by Google.
We do not give legal advice on Google's terms and do not guarantee that any particular use is permitted. Google may change, restrict or discontinue its API at any time, and we are not liable for that.
10. Refunds and your statutory rights
- These terms are written mainly for business clients. If you are a consumer, nothing here limits your mandatory statutory rights.
- Services. Work is made to your brief. Deposits cover work already started and are not refundable once work has begun, to the extent the law allows.
- Products. If a Product does not work as described and we cannot fix it, we will refund you. Business customers should contact us within 14 days of purchase; consumers have the conformity rights that EU and Slovenian law give them for digital content. Refunds are paid through Gumroad.
- Right of withdrawal. EU consumers can normally withdraw from a distance contract within 14 days. For digital content that right ends once supply has begun with your prior express consent and acknowledgement, where EU consumer law allows this.
11. Warranty and liability
- We perform Services with reasonable skill and care. Products are supplied "as is". We do not promise uninterrupted or error-free operation or fitness for a particular purpose, subject to mandatory law.
- Our total liability for any claim relating to a Service or Product is limited to the amount you paid for it. We are not liable for indirect or consequential loss such as lost profit, lost data or lost business.
- Nothing in these terms excludes liability for intent or gross negligence, for death or personal injury, or for anything the law does not allow us to limit.
- Please back up your scenes and data before using any plugin.
12. Cancellation and termination
- You can cancel a Service project before delivery by written notice. You then pay for the work done up to that point and for costs we cannot cancel. Any deposit is credited against that amount.
- Either side may end the contract if the other commits a material breach and does not fix it within 7 days of written notice.
13. Privacy
- The data controller is Vizualne komunikacije Predrag Petrović s.p. (details in section 1).
- If you write to us, we process your name, email address and message to answer you and to prepare or perform a contract. We keep it as long as needed for that and for legal record-keeping such as accounting.
- If you buy a Product, Gumroad passes us your name, email address, country and purchase details. We use them to deliver the Product, provide support and keep accounting records for as long as Slovenian tax law requires (currently 10 years). Payment data is processed by Gumroad under its own privacy policy.
- This website has no analytics or advertising cookies. It remembers your language choice in your browser's local storage. Fonts and scripts load from Google Fonts, cdnjs and jsDelivr, and those providers may receive your IP address and browser details.
- Links to Instagram, YouTube and Gumroad lead to third-party sites with their own privacy policies.
- Under the GDPR you may ask us for access to, correction, erasure, restriction or portability of your data, and you may object to its processing. You may also complain to the Information Commissioner of the Republic of Slovenia.
14. Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control, including outages of cloud, render or AI services, changes to third-party APIs, power or network failures and illness. Dates move by the length of the interruption.
15. General
- These terms and any confirmed quote are the whole agreement between us on their subject. Changes must be in writing.
- If a provision turns out to be invalid, the rest stays in force.
- You may not transfer your rights or duties to anyone else without our written consent.
- Notices may be given by email. These terms are written in English. Where we provide a Slovenian version, consumers resident in Slovenia may rely on it; in all other cases the English text prevails.
16. Governing law and disputes
Slovenian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The competent court in Ljubljana decides disputes. Consumers keep the protection of mandatory law in their country of residence and may bring a claim in the courts there.
Out-of-court dispute resolution. In line with the Slovenian Act on Out-of-Court Resolution of Consumer Disputes (ZIsRPS), we state that we do not recognise any out-of-court consumer dispute resolution provider as competent for disputes arising from these terms.
17. Changes to these terms
We may update these terms. The version in force when you accepted a quote or bought a Product applies to that order. The current version is always available from the link in the footer of this website.
